INTRODUCTION
These Terms & Conditions govern the use of the Build & Kept LLC website and the purchase and use of services provided by Build & Kept LLC (“Build & Kept,” “we,” “us,” or “our”).
By using this website, purchasing our services, or otherwise engaging Build & Kept, you agree to these Terms & Conditions. Clients who purchase Home File services may also be required to enter into a separate Client Service Agreement. If a provision of that agreement conflicts with these Terms & Conditions regarding the services provided to that Client, the Client Service Agreement will control.
OUR SERVICES
Build & Kept provides home record organization and management services. Our services may include creating and maintaining a Home File containing home-related records and information provided by the Client.
Build & Kept does not provide home inspections, engineering services, construction services, legal advice, insurance advice, or professional evaluations of a home’s condition.
PRICING & PAYMENT
Current pricing for Build & Kept services is displayed on our website or otherwise provided to the Client before purchase. Unless otherwise stated, the Home File Setup fee is a one-time fee and must be paid before work on the Client’s Home File begins.
Optional Monthly Home File Management is billed monthly at the rate agreed upon at enrollment. Monthly services continue until canceled in accordance with the applicable Client Service Agreement.
Payments may be processed through a third-party payment processor. By submitting payment information, you authorize the applicable charges associated with the services you purchase.
FAILED OR PAST-DUE PAYMENTS
If a recurring payment is declined, returned, or otherwise unpaid, Monthly Home File Management services may be suspended until the account is brought current. Build & Kept is not required to process or organize newly submitted records while an account is past due.
Access to a managed digital Home File may also be temporarily suspended in accordance with the Client Service Agreement.
CANCELLATION
Monthly Home File Management may be canceled in accordance with the Client Service Agreement. Cancellation stops future monthly services and charges as provided in that agreement. Fees already paid for services provided are generally non-refundable unless otherwise required by law or agreed to in writing by Build & Kept.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Build & Kept will not be liable for losses or damages resulting from inaccurate, incomplete, missing, or outdated information provided by a Client or third party, or from a Client’s reliance on records maintained within a Home File.
Build & Kept does not guarantee the availability, validity, or enforceability of third-party warranties, inspection reports, service records, or other documents maintained within a Home File.
THIRD-PARTY SERVICES
Build & Kept may use third-party service providers to support services such as payment processing, website hosting, email, and electronic document storage. Build & Kept is not responsible for interruptions, outages, or other issues caused by third-party platforms that are outside Build & Kept’s reasonable control.
WEBSITE USE
The information provided on this website is for general informational purposes and to describe Build & Kept’s services. Website content should not be considered legal, financial, insurance, construction, engineering, inspection, or other professional advice.
Build & Kept may update, modify, or remove website content, service descriptions, pricing, or availability from time to time.
CHANGES TO THESE TERMS
Build & Kept may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated “Last Updated” date.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the State of South Carolina, without regard to its conflict-of-law principles.

CLIENT RECORDS & HOME FILES
Clients retain ownership of the home-related records and documents they provide to Build & Kept. Build & Kept does not claim ownership of a Client’s original records or documents.
Clients are responsible for providing accurate information and submitting records necessary for Build & Kept to create and maintain their Home File. Build & Kept is not responsible for records or information that are not provided or otherwise made available to us.
BUILD & KEPT MATERIALS
Build & Kept retains ownership of its proprietary templates, organizational systems, processes, document structures, branding, website content, and other business materials.
The purchase of Build & Kept services does not transfer ownership of these materials to the Client or grant permission to reproduce, distribute, sell, or commercially use Build & Kept’s proprietary materials without written permission.
DIGITAL HOME FILE ACCESS
Access to a managed digital Home File may be provided as part of Build & Kept’s services and is subject to applicable payment, suspension, cancellation, and termination terms.
After Monthly Home File Management ends, Build & Kept is not required to continue hosting, maintaining, organizing, or updating the Client’s digital Home File. Provided the Client’s account is paid in full, the Client will be given an opportunity to obtain a copy of their home-related records and information in accordance with the Client Service Agreement.
ACCURACY OF INFORMATION
Build & Kept organizes and manages information and records provided by Clients and third parties. Build & Kept does not independently verify the accuracy, completeness, validity, or current status of warranties, inspection reports, service records, maintenance information, or other documents provided to us.
Clients are responsible for reviewing their Home File and notifying Build & Kept of any information that is inaccurate, incomplete, or outdated.
SCOPE OF SERVICES
Build & Kept provides home record organization and management services only. Information contained within a Home File is maintained for organizational and recordkeeping purposes and should not be considered professional advice or an evaluation of a home’s condition.
Build & Kept does not guarantee that a Home File will contain every record associated with a property, particularly when documents or information have not been provided or made available to us.
